Enforcement of CAO hearing

I’m after a bit of help if possible please, very long story but in a nutshell

Have a 3 year old girl

Had a CAO finalised in January 2023 and since may the mum has been breaching it

She has claimed that i was sexually abusing my 3 year old - complete lie to disrupt the CAO

been cleared 3 times now by social services, police, doctors and paediatricians. The mum

Kept on making official complaints about all the services to further delay things

Went back to court in August as she started breaching the order  and they ordered a section 7 report

This has now been completed and they have stated that the only concern now is parental conflict as a result of all this and they want my contact to begin again unsupervised with overnights.

They have suggested that my contact is to continue as per my court order with overnights etc but just a change of handover arrangements to keep me and the mum apart (when the sexual abuse lie came to nothing she then cited domestic violence from me to the mum..again she has zero evidence of this as it never happened)

I have been seeing my 3 year old in a contact centre for 3 hours every 2 weeks since August.

She is now stating inadequate parenting as I don’t adhere exactly to her strict routine.

My question is, I have a hearing next week listed for an hour, I’m going to assume I won’t get anywhere with that hearing when it comes to contact and they will list it for a final hearing in the next few months.

The application I made is for an enforcement of my original CAO, the mum has submitted a c100 for an amendment to the original CAO, based on that would I be allowed by the court to try and change my daughters residency? There are several reasons that i now want this, criminal record, mental health difficulties, medication the mum is on, family issues that she has and suitability of grandparents on her side (as she had her own kids taken off here when they were very young) and it is stated in the section 7 that they doubt the mums ability to promote a healthy relationship with me. It also states that they worry that my daughter’s relationship with me may become strained the longer this goes on.

Also a barrister for this hearing is £2000 plus, is this really necessary when a final decision cannot be made?

It’s such a bad system, I have another 8 year old girl that I have with me half the time, I look after my sisters young children and also a stepson who is 4.

So frustrating that someone can make these false allegations with zero proof and get away with it just to stop a court order. 2 years and counting I’ve been fighting for this.

hi, 

£2000 on a barrister I think is very expensive. and hearing could last only 1-2 hours. You have a positive S7 report that states your unsupervised overnight contact should resume as soon as possible. 95% chance the courts will agree to this recommendation. with the right guidance you can self-represent at these hearings.

I think it's highly unlikely the courts will change residency of child if you seek it. seems their only concern is parental conflict. with the right guidance you can self-represent and save on costs. feel free to get in touch if you need advice. sending you a private message.

You could contact dadsunlimited for advice and information. They also have access to lawyers at a reasonable cost
