[Solved] Education welfare sharing of info

Hi All,

I had been informed by my sons school that his mother has been referred to the education welfare officer. I have been made aware by the school that they have made home visits and follow ups at school. Of course this is concerning and I contacted them today. I received the following email below via egress and will be calling the manager in the morning. I just wanted some help in knowing what I am entitled to be informed about. It is my son but they are trying to say they are working with the mum so cannot share any information-see below.
Does anyone have any thoughts?

Dear Mr XXXXX

Thank you for your contact today regarding your son. Following our telephone conversation I consulted with my Manager, who advised that to conform to GDPR, any request for written information would need to be made to our service directly by your legal representative.

I suppose it depends on the information being given out, but I can't see that you shouldn't be entitled to the same information that the mother has access to. I can't see that a legal representative would have any greater access than you would directly. You could keep it civil, but state that you don't have a legal representative, and can they point you to the specific regulation under GDPR that they are referring to? Chances are, they won't be able to.

I believe that if it is the mother's difficulties that are causing the attendance problems rather than the childs then they cannot be shared with you as you are not entitled to her information.

So say for example mum is suffering from mental health issues or physical health issues and as a result some days is unable to take child to school. Education welfare will be working to put support in place to ensure child can get to school anyway whether lift with friend, taxi, school assisted transport, being allowed to go in late etc.

You would be entitled to know your child's absence statistics, and I believe the alternate method of how to get him to school but that will be it.

They will also be very wary about sharing the alternate method because if it's happening due to someone else's difficulties they will get in more trouble sharing with you someone else's info than they will just not sharing the info with you.

Do you see your son? I'm not sure how to advance search so I can't see your history I'm sorry.
