I'd just pay the £215 and start afresh with a new child arrangement order application just fill out another c100 requesting a rock solid schedule of contact out of the contact centre don't even mention the ex base it solely on unsupervised access on your own with your daughter.

Technically she hasn't really broke the order so go for a fresh application it will put you in good stead as you've had so long in the CC start thinking about the amount of contact you like starting off with atleast 2 hours each week for say 6 weeks then 6 weeks of 4 hours a week for another 6 weeks then over nights to start after that dont forget to put special occasions down ect to with xmas equally split go for more and you wont be too upset if they order less.

Also do a parenting plan and when you make the fresh application have a decent position statement lined up with a rock solid schedule of progressive contact and a parenting plan and you'll be sound 🙂

As you've attended mediation recently, have a word with the mediator and ask them to sign the C100 form off for you, as your ex is refusing to allow contact to progress and you need to make an application to court. There may be a charge for this but you will need them to sign the form before you can make the application.

so here's my update ......new problem! she wouldn't let me take her out so I wouldn't sign the passport. she has now said she will stop contact and take me back to court...the agreement was that I take her out, outside the contact centre and then I sign the passport form...can she still get my daughter a passport even if I don't sign? the down fall is that it states in our contact order that I will sign the passport once I get contact with my daughter. ...what is the best form to get in first ? would it be the C79 enforcement form?

...you can apply for enforcement, as we have discussed previously and you would need form C79 to apply the application. With this type of action mediation isn't a requirement and it usually gets listed quite quickly....however that does depend on how busy the court is.

Best of luck

ok so im going to apply for the c100 form today, ( taken me a while to get the funds together!) Just looking for some advice now as to what I should include. all I want is days and times to pick my daughter up and drop her off and get out of the contact centre ( mother still refusing to take it out of the CC) any advice on filling in these forms would be great!
