[Solved] Discharging non-molestation order

Hi Guys,

I was served a 'without notice' non mol and I'm a university student. It was all based on lies - she accused me of 'stalking' her at university even though I've not seen her in 8 months.

I was banned from my uni as a condition of the order and the judge paid no attention to this?

Anyways, the uni ban was discharged and I uneasily accepted the order so that I could get on with my life.. now she is using it at university to take action against me such as having me banned from various buildings? etc.

Anyway, I applied to get my own order on her, which resulted in her signing an undertaking not to harass me on the internet or social media or contact me by any means etc.

When the court asked her to serve evidence (which she was given four weeks), she failed to serve it!

I am now applying to discharge the application as there is no evidence served? and nothing supporting it?

the police investigated me and took no further action and are now investigating her for harassment and one other offence?

any advice?

Go to court and contest it .. family court don’t tend to strike things off
Due to no evidence by default unlike criminal court . At contested hearing if she stil
Hasn’t served evidence you’ll
Prob be ok . Imagine to get the order without notice she would
Have had to produce something to the court already ?
Guess all you can do
Is produce evidence to show she lied etc

all she produced was oral allegations and a set of text messages that were sent four months before the order applied for. she also asked me for [censored] in these messages.

apart from that , no evidence apart from bogus risk assessments from 'women's charities'

Maybe you could go along the line of both accepting recitals in court and you won’t Persue her Via the police .
Guess it depends on the content of the texts . If she’s got no evidence I imagine you’ll get it discharged , the police being on your side is def good for you
