Hi to all

Im new to this sight and need help!

I pay my ex wife child support threw csa could i make a private arrangment to pay my ex wife directly without dealing with the csa?

Also i have a contact order since 2007 to see my some every fortnight for 4 hours my ex partner after 3 years of contact would not let me see my son and also got him to tell me that he does not want me to come and see him anymore. Could you please advice if the contact order i have is it still in force or do i need to go to court to get another order? as i have not recieved anything from the courts informing me the the contact order has been cancelled :boohoo:

Hi

You are able to make a private arrangement and avoid using the CSA, it's called a family based arrangement, but you would need agreement from your ex to do this, and she would have to notify the CSA that she wants the case closed.

Regarding the contact order, these remain in force until your son is age 16 generally, or unless superceded by a new contact order, but if your ex went to court to vary the contact order, you would have to be notified that this was going to happen so that you could argue your side, and unless there are serious welfare concerns, a court is not going to stop contact as they encourage contact with both parents. If she will not agree to contact, then you are going to need to get the contact order enforced.

also regarding the payments i make to the csa does she recieve the full amount that i pay! as she is on benefits and does not work?

...Thats a good question and one I've often wondered about! I was under the impression that when a mother is in receipt of benefits then all CSA payments go to the state...but I'm not at all sure of that.

the reason i asked the adove question was when i started paying the csa i was informed by a citizen advice employer that the benefits my ex wife has recieved (she has never work ) will be deducted from the csa payments that i make until all monies she recieved for my son have been payed back! and is she does not go into part time of full time emplyment she will never recieve a penny of the money i pay the csa!

...Thats what I understand to be the case too... and if the parent that is receiving benefits get extra cash in hand from the other parent, instead of going through the CSA, and doesnt tell the Benefits office about it, that is classed as fraud.

Yes but i made direct payment to my ex for over 5years and when the csa contacted me inform me that i had not payed a penny towards my child i gave them details of 5 year payments i made to my ex which they stated that you do not have proof that states you was making the payment for your child! could be moneys you owed her or anything!

You say fraud i have been taken to the cleaners and back and till this day can't even ring or see my son!!!!
