She’s prob made allegations of domestic abuse / harm to the kids etc hence they’ve ordered the section 7 . Family court aren’t that formal with people not attending or not filing as ordered . Well not in my exes case . All you can do is expect her to sling mud and defend any allegations . Don’t rise to it , don’t send her any crappy emails texts etc as she’ll say to the court see this is exactly what I’ve said he’s like

This is a interesting one because on her application form she ticked the no box and didnt provide the supplementary information which surprised me at the time. So when the allegations come my way I'm going to query why she never did that.
But she clearly put something in that letter that has made them change what they originally said they were going to order. Surely they should share that letter with me?
This was the first directions hearing that she couldn't be bothered to turn up to, that hearing is supposed to decide how the case is to proceed, her non attendance made it right that the hearing was rearranged, she needed to be there, agreements could have been made etc. Although she sent a letter, the fact is we can now go through all this and she fails to attend so will be a complete waste of time.

you could challenge all this, but I think you will just burn yourself out. let cafcass deal with it. as part of S7 they will talk to local social services anyway. they will interview you, and you can give detailed history about whats happened.

How would I challenge this? Because I fully intend to. They are saying the next hearing could be the final hearing, it feels like they are trying to court corners and I'm not having that. There is many issues that need to be discussed before we proceed really.
As she didnt attend the 1st hearing I was fully attending to go in and ask for this to be dismissed, but as they suggested that we postpone the hearing and hold it again I just went along with that. I wouldnt have went along with what they have instead ordered and I think its shitty that they have made an order based on a letter, rather than have both sides give representations.
If the next hearing is a final hearing then that would be a good thing. I think they are referring to your ex not making an appearance. the 1st hearing nothing much normally happens, the fact she didn't show wouldn't be a big issue albeit it wouldn't of done her any favours. she had wrote a letter which they wouldn't of disclosed to yourself understandably. It could get to next hearing and either cafcass will do a s7 or it may mean if social services have been involved in past they could be involved. it sounds like social services closed the case as children were in your care and they were happy with that . would say you are the protective factor. if case closed it would be left for cafcass to do s7. meanwhile she has had no chance to have a say and you keep your son for at least another 3 months. if she is having no contact at moment, the most she will get at next hearing is supervised contact if that . your ex may not even show up at next hearing. meanwhile if your son is doing well at school and is happy and social services are on your side best to remain positive. when cafcass do phone social services up asking after your ex they aren't going to speak very highly of her so report should favour you a bit as well.
Don't bother challenging or raring up, everything will be fine as long as you come across child focused calm and think of the long game whats at the end

I put in a c2 application and explained all I have said on this thread.
I had a letter from the court today and they acknowledged that they varied the order after the hearing in my absense based on the letter they recieved from mother and have ordered a directions hearing takes place in two weeks like I requested.
