[Solved] Court Mess around by ex.

Ex got a prohibited steps order this was dismissed as it found she misled the court - which was recorded on court order.

She then asked for more nights i agreed so I have them 4 & 2 nights not 4 & 3 nights i had them before.

She wanted more weekends so we changed the days.

1st time at first hearing she then stated DV (never had done in previous hearings)

Told to do a scott schedule with a deadline she didnt submit anything , Solicitor wrote to court who issued another letter saying she had not stuck to court order gave her an extension on scott schedule and on letter stated if she didnt submit anything by extended deadline she couldnt use it.

Guess what she didnt submit anything... so now have findings hearing over 2 days , my guess is she wont turn up.

Would you say my chances of re-instating 50/50 shared care are valid?

She has messed me about , cost me my deposit on my new home due to costs

A few questions...

Surely she has discredited herself enough , what happens if she doesnt turn up at court?

Can i claim back legal costs ?

In court its all been unfounded allegations and my solicitor defending me but we have told our side yet .. so what next ?

Can i go for full custody due to concerns raised with Cafcass and Social Services?

The chances of you getting costs back are extremely remote, so I wouldn't waste energy on this. She certainly isn't going to be helping her case by not turning up. I'd certainly look at a shared care arrangement, though the question is whether she will stick to it.

What concerns do Cafcass and Childrens Services have? It might be worth having a word with them to get their opinion on you applying for residence, ie a child arrangement order where the child resides with you.
