You wont need a bundle for 1st hearing. as far as I am aware you only provide bundles if you are represented by a solicitor / barrister.
Its an urgent hearing so a position statement outlining what you want /seeking would be needed . Also if you got some factual evidence that show she has alcohol issues. when going to court you want to say something like mums alcohol/drug misuse is having an impact on her capabilities to look after our child on a day to day basis. I would like the courts to carry out an alcohol/drugs test which will clearly show there is a major long ongoing issue.

I am guessing you will have a district judge and not magistrates at Mondays hearing. With social services not currently fighting your corner I don't think they will give you residency or put child into your care ,but they should order interim contact hopefully until next hearing is scheduled.

Alcohol test may be ordered but depends on judge , they may even request you pay for it as its over a few hundred pounds at least. whatever you wrote in application to get urgent hearing is what you will need hopefully able to have evidence for.

Its a long game remember and your battle is at a very early stage..if she is a chronic alcohol/drugs abuser eventually after a long period things will turn in your favour. social services are highly likely potentially to be involved after your hearing. judge is probably going to want their reports so far and other background

Thankyou this was very helpful. She is under an alcohol service but not sure how I can prove this? Not sure if they would write a report for me to be honest?
I have 40% residency at present of my daughter and I had her for 2 months 100% last year when drink and drugs spiralled out of control. I know I won’t get full residency but I’m hoping I will get more than 40% and at least my mind is at rest knowing she is with me the majority of the time. I’m preparing for a long journey, just want to make sure I’m prepared for Monday

hi,

there should be court social worker (cafcass) talking to you on day of hearing. tell them about drugs/alcohol issue and they will do all the investigating. they will do police checks and check with local social services. they will probably want to do a section 7 report, so another chance for you to give all the details about ex's issues.
