I heard off the court on Friday I will have a yes/no off the circuit judge on this coming Wednesday/Thursday if my application to appeal is successful, cost me £215 in court fee just to apply.

I literally have everything crossed it's going to go in my favor.

I've had a response, the judge has sent a transcript down to admin requesting more information.

I will find out in the morning exactly what and get it together asap.

Anyone know how long the transcript companies take to get the info back to you, court papers say 2 days but their own paperwork says 7 working days?

Anyone had any dealings with them?

Long story short the judge has requested a transcript of the non parte' hearing I wasn't in attendance too. I don't know what it is he's looking for but looks like I have a good shot at my appeal going through.

Last hurdle before a decision is made on a possible hearing

I would say 7 days is about average.

It's good that the judge is investigating thoroughly. I appreciate the waiting is agony, but hopefully this will go through for you if it turns out there has been an error in law at the ex parte hearing.

Wow, today I got my first real taste of how inadequate and unreliable the justice system really is.

I filed a non-parte' prohibited steps order today against the mother in law, as she's being extremely aggressive and unpredictable around the children, putting them at risk on numerous occassions.

The judge mixed up the court papers not once, but 4 times, tried to give me an order on a previous closed hearing from October. After getting agitated he was making obvious mistakes, for all to see, he never even opened the file or read the statement of the PSO he just said, "it wouldn't be right to deal with the PSO without the mother in law there as she can't defend herself".....Hypocritical b**d, same judge who forced one on me when I wasn't in attendance.

He's set a date for 4 weeks, 4 weeks that my children are in immediate risk, 4 weeks of additional worry and remember he never even opened the file.....Horrible horrible decision, one that he should hang his head in shame at.

Cafcass, safeguarding, and the police will not do anything as court litigation is in progress.....the system is well sorry to swear but f*d!

The transcript went into court on Friday, suprising to find out that the judge wasn't going to allow the prohibited steps order there and then, but her solicitor pushed saying "it'd be easier for the court to deal with it now"....seriously easier, how?.

Annoyingly the judge agreed.

That being said, that was the final piece for the judge to make a decision on the appeal, hopefully I can finally get some good news.
I want my kids back!

I'm really sorry to hear this, it's not the end as you have a hearing in February... take some time out to recharge and be kind to yourself, then come back to it ready to fully focus on getting contact in place. Patience will be your best friend in the coming months... it's hard and we all understand how it feels, we are here to advise and support you as much as we can.

Well my final last option is a Court of Appeal hearing but the costs are horrific more than double family court and I just don't have it.

Decided that i'd try and raise the funds another way

Not sure what you've set up is worded quite rightly for any possible application for varying the order in future, i mean no disrespect because i know just how hard it is going through the biased and broken family court system, but maybe remove the part about considered ending it....she'll use that in future to suggest you are unstable and more of a danger to the kids.

just a thought, have you been in contact with your local Families Need Fathers group? i found them quite helpful when needing to talk to live people rather than post on a forum and wait on for someone to reply.
