seems your solicitor has it in hand and itis in fact contempt of court for not sticking to an order
make sure when you file for enforcement that you have copies of the reports attached so the judge can read and copies sent to her
It's very clear that your ex is breaking the court order.
i always gave my ex 3 chances by using the "3 strike rule"
Strike one: 1st break in contact - i email for contact to not be broken again and to take place the following week without issue.
Strike two: 2nd break in contact - i email reminding her of the court ordered contact and that should it not take place then i will contact court
Strike three: 3rd break in contact - i don't contact her, i apply to court for enforcement and submit court papers to her.
She can be given benefit of the doubt by court for one possibly two breaks in sucessive weeks contact - child illness, transport breakdown, snowed in etc... however 3 or more she would need a [censored] good reason to do it without the court acting to enforce contact.
your lawyer has a good grip on it by the sounds of things, make sure hte contact centre reports are filed as evidence and that shows it clear as day.
I think the judge would need to be blind and stupid to ignore the contact centre reports and the clear breach of the order, if there is any justice then your ex is in for a grilling as to why she feels she can go against clear court orders and the proven good contact for your kids.
fingers crossed for a judge willing to do something
hi kenny, so have i got this right? your in contact center now,, court order,? and you ex partner is not taking the children to center to see you,, and that contact center,, staff have good reports about contact that you did have,
Your lawyer should ask for it to br brought back to court quickly due to it being enforcement of contact now. however, it will depend on the court and how busy they are, mine took nearly six months to get back in front of a judge but that was for a full day hearing and now 3months for the next directions hearing.
i was told it should've only been 4-6wks
id now ask the court that contact be advanced to unsupervised out of the centre π
