Hi all
I am after some advice. My children are 15 and 12. I do not get on with the mother at all and we have been separated for well over 6 years now. I am in a new relationship and due to get married next year.
Ever since i have been in my new relationship my ex has got increasingly difficult and threatening all sorts.
Her new one is stopping all contact or supervised visits only.
Her issue is money based, we have an agreed amount that i pay each week, sometimes it can be a day late due to my job. Or sometimes im 15/20mins late picking the children up on my weekend. By daughter is i formed when im running late and is ok with this, she is 15.
My ex does not like me communicating with my daughter with regards to pick up and drop off times etc..... she says this is emotional abuse, my daughter has no issue.
What is legally right here?
My new partner had an issue with her ex when they first split u, she was advised by a solicitor that if the eldest child has a phone then she was legally able to communicate with that child and not the father.
Do you have a child arrangements order in place through the court or is the current contact mutually agreed since you separated?
Hi there
Its pretty common for exs to play up when a new partner comes on the scene.
The children are getting too old for supervised contact imo! As long as your daughter is happy to have phone contact theres absolutely nothing wrong with it and claiming its child abuse is just ridiculous.
There is no legal right or wrong, but lets put it in perspective, once your daughter is 16 she can decide where and with whom she wants to live, so giving her a call if you're running late is perfectly reasonable.
Maintenance and contact are entirely separate issues and one has no bearing on the other.
From your post i assume there arent any court orders in place. You could try mediation to try and stop her messing with the agreed contact, if that didnt work you could consider court if she continues to suspend contact. However once your oldest daughter reaches 16 any court order concerning her would no longer be in effect... it might be worth it for your 12 yr old though.
All the best
mutually agreed
