Hi,
My wife is looking to start proceedings for divorce on the grounds of unreasonable behaviour ( We have been split since June this year)
I do not and will not agree to this as it is simply not true and she knows that aswell.
Am I within my rights to not consent to a divorce and in doing so, can she still petition for divorce proceedings without my consent?
Cheers
Hi,
I am talking from my own experienve, You can contest the reasoning of the divorce application if you don't agree with the reason.
What i would say though as the divorce is a means to an end, what is wriiten on the paper doesn't really mean much but will allow you to be able to close the door and move on with your life.
I know it's hard for it to be put in writting and in effect have the blame of the break down placed on you, but unless there is a very strong reason (I don't mean to be blunt here) other than your feelings then personally I would just accept it and allow the process to move forward, the papers will get filled away in a drawer somewhere and probably not be seen for a long time.
No matter what is written on the papers you will know what happened and that's the main thing.
Only other suggestion, is to ask for the divorce on grounds of irreconcillible differences, as that would share the blame.
Nut don't get too hung up on it, as we always say pick your battles and work out in the long term which ones are worth fighting.

Thanks GTTS,
A great support as always 🙂
I'll give it some thought for when I receive a response from her solicitor about next course of action...
Cheers
My ex contested my divorce and we both had to attend court, the judge called him extremely foolish for contesting it and granted it anyway, ordering him to pay costs
At the end of the day, it's a piece of paper that no one else has to see, if the shoe had been on the other foot, I'd have happily signed anything.
As croc says, chances are the court will grant it anyway, and by contesting it, you may even add to the argument that you are being unreasonable. Just get it done as soon as possible so you can move on.
I've agreed that divorce is the way forward, however not agreed to the grounds of unreasonable behaviour.
The issue I have with divorce is that my financial position is so dire that I would end up with nothing and nowhere to live if the sale of the house is forced.
The debt she has left me in is unbelievable.
Though unusual the divorce can be sorted though the courts and the finances left open to be dealt with at a later date.
I don't know how easy this is to do, but I know it happened with mine.
