[Solved] Child support

I spilt from my wife in 2003, I became sole carer for my 2 daughters. I was working part time and struggled financially but i managed. I was sole care for some 6 years, will no financial support from their mother. My eldest is now at University living away from home. My youngest 17 is now living with her mother and new husband. She has now gone to the CSA to take me too the cleaners. I am in a relationship with my partner who has 3 young children. Am I able to take a civil claim out against my Ex wifer for the years she did not contibute to thier up bringing. Part of this time she was married and both earning money, her husband is a Police officer.

Hi Ian and welcome to the site!

I'm sorry to hear about your problem. My experience of the CSA is very limited, but as I understand it you cannot make a retrospective claim for child maintanence through them. Whether you can take out a seperate litigation is not something I can advise on, but I suspect that this would be difficult and you would have to evidence that your ex had breached an existing agreement.

I will ask someone from Child Maintence Options to pop by and advise further. Please keep checking back, as it may take a couple of days for them to respond.

I agree with FM, I think it is extremely unlikely that you'd be able to take any action, but hopefully the CMO will give a definitive answer.

The moderators are correct, you cannot retrospectively apply to the CSA for child maintenance owed in the past.

The CSA work out child maintenance as a percentage of the paying parents income - this is to ensure that payments are affordable. The CSA will take into account any other children that live in your household and also any other children that you are required to pay maintenance for via a court order. You can get an idea of what your payments will be using the Child Maintenance Options calculator:
