Split with my ex wife almost 2 years ago when she had an affair...i moved into private rented accomadation and my our 2 daughters now aged 7 and 4 respectively lived with me for 3 months full time and hardly saw their mum. i had meetings with my employer and i was allowed to job share....i gave up my promotion and full time hours and dropped to 17.5 hours a week on a 2 on 4 off rota incorporating day shifts one week and back shifts the next...this i did to look after my daughters. My ex was threatning on seeking full custody of kids but said if i signed over the tax credits and family allowance for the youngest one she would have the kids 3 nights then i have them 3 nights and its fitted perfectly around my shifts.
We have had the exact same routine in place now for well over a year...Now she is trying to say she wants them ful time, but weekdays and i just see them weekends.
I had the child and working tax credits and familyallowance for both children in the first 3 months and then had the tax credits etc for just the eldest girl for the last 21 months. We live in scotland...so Scottish law
Surely as ive had both girls living with me longer over the 2 year period and the fact ive always had the eldest daughters govt monies come to myself i must be the main carer am i not. Girls both doing well at school too.
My ex is now not keeping to our arrangement of nights when they stay with us, what are my rights regarding custody as it now looks as it is going to be a battle between lawyers...also will i get legal aid as i earn £147 net a week

Hi Carl

As you are in Scotland, contact the Scottish Child Law centre - www.sclc.org.uk - hopefully they will be able to give some advice, but post back on here to let us know how you get on. Personally speaking, as you seem to have been the main carer, I would say that it might be worth considering applying for full residence. It will also be quite telling to a court that your ex seems to be motivated by money more than anything else.
