I am English,my ex partner is polish, she told me she was expecting my child on her return to Poland, she had the child in poland, problems caused us to break before the child was born, but now 2 years on she demands money and states that i should send her child tax credits and such alike, to which i have never claimed before ,where do i stand ? as im not sure that the child is mine. what rights does she have over me?

Hi There,
.
I'm not sure that you would be able to claim any child tax credits for a child that doesn't live with you let alone one that doesn't live in this country.
.
I don't know too much about tax credits but I think as much as I understand I am right in thinking the above.

I agree with GTTS - you could ring HMRC to check this, but I suspect she'd have to claim in her own country for any allowances. I would open a case with CMS immediately though, because if you don't she may well open a case there and I seem to recall that Poland might impose quite high maintenance, and if a case is opened over there, then the courts wouldn't overrule it here.

... but if he doubts the child is his, would it be advisable to open a case with the CMS?
