Hi just looking for some advice
My ex has breached an contact oder that has been in place since 25/11/16 to say that my visits with my lad are to be gradually increased, not one session has gone on longer than it was initially set up for (10am-2pm) these sessions are every other saturday but it states she is supposed to increase them gradually to be all saturday - this has never happened and she has told me straight she wont or haas a na excuse he is busy (he is two and seems to have a better social life than me lol )
the contact order already has the warning on it so there is no point in me applying for that but the c79 which is an enforcement order is to get her in trouble and give her community service which I'm nit that bothered about - what i want is for my visits to be increased anyone got any ideas the best way to go about it????
Hi there
Before you think about applying for an enforcement order you could try writing directly to the judge that made the order to tell them about what is happening and ask if it would be possible for the case to be called back to court for urgent new directions. Judges have discretionary powers to do this, some will, some won't, but it's worth a try. As the order has only been in place for three months and no progression has happened and in fact she is refusing to do so, the judge just might order it back to court.
Best of luck
