My child was registered without my knowledge and took the mothers name, been going through courts etc for last year and hopefully near the end now. I've applied for Parental responsibility so hopefully be granted that also.

I would like my child to take my surname or at least have it added on to his current name, is this possible? What would I need to do? Does mother need to agree? Or can the judge order it?

Dec in my view i think you'll need to be on the birth certificate for you to challenge the surname of the child but don't count me on it.

Hi Dec

you need to obtain PR first and once that has been granted, at the same hearing, ask that the child's name be changed.

Thank you think that was what I was trying to explain, will the judge be able to order that the child has his name changed or does mother have to agree?

If there is no marriage I don't know how you could change the childs name, regardless of PR, just my opinion.

No you can ask the Court but it will depend on the interest of the child. 🙂

I would think its very rare for a court to order the name changed from the one that was registered, except under exceptional circumstances....I wouldn't want Dec to get his hopes up and think its a formality.
