[Solved] changing a court order

Hi guys never thought id have to come back but in need of advice.
I won a contact order to see my daughter and at the same time i got a new job by norway..I suggested to the court i can see my child every 8 weeks until im settled then review it, not ideal but better than nothing. they agreed.
Ive been in my job now for 4 months and its going great and they have agreed to give me every month off to see my daughter, but the mother is refusing and wanting to stick to the court order of every 8 weeks out of pure spite...
I did google to see if i can change the court order and it seems i can if i supply evidence to support it etc..Can anybody give any advice on what direction and what forms i need to use??

If your order was issued recently and details that further contact is to be agreed between the parties, you could try writing to the judge that issued the order to seek their advice. Failing that, you would have to apply for a variation on a C100 and most likely, attend mediation again. I would try writing to the court first and attach copies of communication between your and your ex on the matter.

...I think the fact that you are based in Norway may exempt you from mediation. Perhaps you can contact the mediator and discuss this, if the exemption applies here they will sign off the C100 that you need to apply for a variation.

It's a good idea to write to the judge that made the order though, just in case they are of a mind to step in.

will i have to pay another £215 to make this order or does it come under the same price as the last one i made?

If you write to the court with your case number before submitting a C79, they will advise if they require the form and the fee. Should the fee be payable, it's listed as 95 pounds on the justice website 🙂

Check out the above link to an earlier post which may answer your question. Some courts may be less up to date with current directions, I believe this is covered under the Child Arrangements programme so you could try quoting that at them if they aren't clear about the twelve month rule.

If this applies then you shouldn't have to make a further payment as you original case falls within the 12 months period. Give the court a call.
