Reporting a concern

It can be difficult to know what to do if you think a child is at risk. It’s important to remember that if you’ve spotted things that don’t seem right, others will have too. Speaking up can make sure that child gets help as soon as possible.

 

The sooner you contact your local children’s social care duty team, the quicker they can act. They’re available 24 hours a day, and can make an anonymous report if that feels safer. If a child is in immediate danger, please call the police straight away by dialling 999.

CAO breach - apply for enforcement or a new CAO?

Hiya,

New member here, though I've been muddling through CA+NMO proceedings since July 2022. NMO concluded with joint undertakings in 2022. CA ended with CAO in July 2023 (joint lives with 9/5 in M's favour, 50/50 holidays). 

M has breached the court order a few times to reduce my little one's contact w/ me. I'm concerned that she's about to withhold her from contact in the next few days. Should this occur, I'm wondering whether I ought to be applying for (a) a new CAO, (b) enforcement of existing CAO, or (c) both.

Unsure how much detail is required, though I'm unconvinced the current CAO will work long-term. The court found heavily against M re dishonesty / manipulating professionals vs me, including social services - though the court relied on the social services' report to justify the 9/5 (despite identifying that they clearly hadn't done a good job at assessing her). 

Thanks in advance for any assistance. I'm currently working on putting together a case for TOLATA / finances re this situ, too, and possibly further NMO revisiting / enforcement as she's breached that a few times too. Fun times!

Hi,

If your not allowed to see child in next few days, then I suggest wait and see what happens. If you don't see child then suggest you apply for enforcement with c79. If you  have records of breaches 2-3 occasions, should help your position.
