Hi
My ex is threatening to take me to small claims court over maintenance money she believes she is owed on a private arrangement?
Can she do this? We have no written agreement and the money she's disputing has been paid through the CSA?
Thanks J
Sorry can you move this to legal or delete it?
Hi there
Just to let you know I'm moving this to legal eagle section and deleting all the other duplicate posts. 🙂
I think anyone can take a case to small claims court but if there's no written agreement in place in relation to the private arrangement you had then I can't see it being successful.
You should point that out to her and tell her that if she is unsuccessful you will be claiming all costs against her....as she is only threatening this it might help her to realise its not as simple as she said, he said, proof is required and she doesn't have any. You would argue that you are now paying through the CSA and had they felt there were any arrears when the case was opened they have the facility to make you pay it ....they haven't done that.
Good luck
