[Solved] CAN JUDGE ORDER CONTACT AT CAFCASS HEARING?

Hi all,

just received court dates

Cafcass schedule 2 by 16th may

Cafcass listing for 18th june (time estimated 30mins)

What do these mean and can I get contact going in the cafcass listing??

Any advice would be great

A CAFCASS schedule 2 is the name of the report that is prepared for the court. It gives a fairly brief summary of the current situation. They interview both parents, usually over the telephone. They will ask what concerns you both have, if any, what your relationship is like with your child and each other, if you have any previous convictions or any previous Social Services involvement...that kind of thing.

I take it the date of 16th May is about the time frame for the interview to take place.

The June date is for the first hearing, which may just involve the CAFCASS officer who will try and get some agreement between you both. If this isn't possible then a further hearing will be set up which may then involve a judge.

Hopefully the CAFCASS advisor will help you to reach some agreement and get contact started/resumed.

Thank you, I just hope and pray she will co-operate so I can resume contact.

By the first hearing it will be 3 months I haven't seen my daughter.

Will it be necessary to have a solicitor present?

Hey Mate,

If you have budget I would have one; if not self-representing is also an option - as NannyJane states mediation is likely to option unless DV/ safeguard issues raised.
There are individuals that can help you (voluntary or paid) that are not lawyers called McKenzie Friends.

It is tough but if you can impress on the judge at the first hearing how detrimental lack of contact with your child has been on their welfare/ well-being then contact (hopefully) can start ASAP.
If offered supervised, take it - but argue (respectfully) a transition into non-supervised over a month period before next hearing date.
