Can I reopen a c100 after final hearing?

Hi all, I’m looking for some help here please, does anyone know if I can reopen a c100 application after a final hearing which was in November 2021? I was told I’d have to go through the whole process again but I wanted to double check.

It’s been 16 months since I lost access to my children, I finally had great news today that a pending police investigation was closed with no further action meaning I can now go back to court to get access to my children after the court originally gave me indirect contact only back in November.

It’s been an awful time not having any access whatsoever, I originally represented myself during the court as I knew I could one day need the funds to fight once everything was all cleared.

I appreciate any advice given.

hi,

It is my understanding that after a final hearing, you have 30 days to appeal it. since that has passed, what you could do is apply again with c100 form, to vary your current order. if there is a non-molestation order against you, or your ex alleges that she can not contact you due to domestic abuse/violence, then you can skip mediation and apply with c100 form. if there has been a significant change in circumstances, then court may accept your new application. you may want to seek legal advice before applying again.

Thanks for the response. Ok that’s what I had read, as it’s been over 30 days and there’s been a significant change in my circumstances I will apply again.

 I’m trying to get legal help but I appreciate the response.
