Hi all,
I unfortunately find myself in the position to submit another C79 due to all indirect contact taken away from me for over a year now. Despite it being on the court order, i am blocked on all phones
Do I submit my position statement with the application or wait until i have a date and submit it to ex & court?
There is a section on the C79 that asks for a brief outline of the issues / breaches. Complete that but don't submit a position statement yet.
You can take the Position Statement with you to the first hearing. If you have evidence of the breaches, mention it in the position statement but don't attach it to the statement as you won't have permission to file evidence.
Just have the evidence with you in case the court feel it's beneficial to see it on the day.

Following a section 7 report, I was asked if I still wanted to go ahead with the enforcement order . I said yes and now need to do a written statement to the court. Do I include the evidence in this statement?
