Hi all
Looking for some advise on the c79 form. Do i put my statement in with it orjust the form for now? Also including sickness there has been 12 breaches do i inckude all these?
Will my court order stay in place while awaiting hearing etc?

Sorry for the delay in responding... I'd just put the form in for now, you can take a brief position statement with you to the first hearing. I don't think you can really challenge illness, unless it's happening excessively. I would just say that ordered contact has been denied on multiple occasions with excuses ranging from illness to making other arrangements, if they have been stopped with little or no notice and no alternative offered, I would mention that too.
Your existing order stays in place, although once the mother gets the enforcement papers she may stop all contact.

Thanks for the reply. Aswell as sickness my ex has put my daughter in nursery 3 days a week even tho the order states to work around fathers shifts. I get 1 midweek day off which varies week to week and it was agreed to work around this but she is in nursery 3 days a week now so its not working around my shifts.
