C2 form, confused on the cost

Hi, I have an existing case involving a child I'm now applying a C2 form to send in because me and the ex have come to an agreement.

Cafcass said to fill out the C2 for a Consent Order and a parenting plan.

I'm confused on the cost though as you need to pay with the C2 but I don't know the cost of sending this in for changes to an existing case?

I'd give the court a call and check with them - make sure they are aware it's an existing case. I have the feeling that because there is already a case open, then there is no court fee, but hopefully someone can confirm or correct this.

I think it's £50 as per this https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/986795/ex50-eng.pdf

On page 18 under the "Applications within proceedings" it mentions £50 for "Application by consent or without notice where no other fee is specified, e.g application to vacate or adjourn a hearing".

Hi,

I been looking up c2 form and seems there is a cost of £215. If you have existing case, do you have a hearing coming up? If so you can turn up and tell them you have both come to agreement, then court would draw up the order, or a lawyer will do it if you or your ex are represented by lawyers.

Yes we have a hearing coming up eventually. We were told directly by Cafcass to apply for a Consent Order and send in a Parenting Plan, so I'm just doing what they're saying.

If you look at the link I gave in a previous post the £215 is for new applications. This is to request a change, which is the C2 form.

Think I'll call the court...

Hi, sorry to rake up an old post but, if the courts decide a C2 application is inappropriate or they say "nah, this doesn't warrant a court hearing", do the fees get repaid? New C2 application is asking for an interim hearing rather than asking for a new order that hasn't been asked for already.

@bruceout hi, C2 form costs £232 as far as i know. info: https://www.gov.uk/government/publications/fees-in-the-civil-and-family-courts-main-fees-ex50

If your on benefits or low income, you may be able to submit form for free, using help with fees form.

Am not sure but I don't think they will refund you the fee if they process your application, then a legal advisor/judge rejects it .
