I'm the Applicant and submitted a C100 Form to the Court in respect of 3 children (two biological and one step child).
I also submitted a C1A Form accompanying this.
I have just received a C1A form from the respondent, we have a Gatekeeping Hearing at the end of Jan.
The accusations are wild and she is looking for a Non Mol against her and step child - lots of false allegations which reads pretty horrifically.
CAFCASS have also not referenced this in their report.
Do I have to respond to these new allegations on the C1A Form before the Gatekeeping hearing? Or wait for the Gatekeeping heating and then respond at our FHDRA? As it will just be backwards and forwards.
Any advice appreciated.
Hi,
Yes you can respond to her allegations. At end of c1a form there are few blank boxes, where you can respond to allegations. Can email to court. Also bring it to your first hearing. Its possible the court may want detailed responses to the allegations, e.g. written statements.
