Hi all,
I've been reading the site for a while never commented but circumstances have pulled me that bit closer!!!
I'm starting down the path of court action in order to see my children, filling out the c100 mind sees my wife and I disagreeing!!
In the section about what you want etc (that should be brief) she understands from previous posts on here that you are to stipulate what you want the court to do ie I want the court to give access on x y z days and for her to travel x y z days!
My understanding however is that you keep it brief and the details of your request gets lumped in your statement.
Any help would be greatly appreciated
Regards
Hi there
Yes try to be brief , the box isn't very big so write it out roughly and get it reduced down as far as you can. If theres not enough room you can use a separate piece of paper and attach it to the back of the application, adding your name.
As you say though, if you are planning to prepare a short position statement you can go into a little more detail in that. A position statement should only be 1/2 A4 pages long and should give a brief background, your concerns and your requests to the court. There is a template that you can use and a format to follow. If you need a link to this just ask.
You are expected to have tried mediation before an application is made, it is now a requirement of the court. Hopefully you will have ticked that box already.
All the best
If you could send me the links that would be great.
So if I merely wrote that I was after a child arrangements order to seek access and went into why that should be enough. It doesn't have to be in more detail like days and all that?
Thanks
If it's not possible le to get your request for access in a sentence or two, then say something like weekly contact to include overnights, or alternate full weekends and a mid weekly visit with extra during school holidays. You can then go into more detail in the position statement.
If you've had regular contact previously mention that too.
I'll dig out the templates and info for you.
Hi there
These links should help
www.thecustodyminefield.com/flapp/positionstatements.html
Keep it short, not more than a couple of pages, stick to the facts and don't bad mouth the mother, you can voice any concerns you have though.
You don't have to send it in with the application form, you can take it in with you to the first hearing, have copies for the other party, CAFCASS and yourself of course.
