You could try speaking to the mediator, how did mediation pan out when you went last time? Is that what helped to improve things for a while?
If you dont think it will work a second time talk to the mediator about it and he might update your form.

The other party originally refused mediation and still does.
I was hoping to re-use the form just to avoid going through same process again...

You can try and cheek it out, the worse that can happen is that they'll tell you to go and try mediation first.
