[Solved] before mediation

I was just wondering what happens prior to mediation? I have a long standing arrangement with my ex-wife whereby my daughter stayed with me every fortnight. She has developed a problem with my new wife, and is denying me access as arranged whilst we wait for mediation. I've seen my daughter every fortnight ever since we separated. Can she legally do this in any way, as she's insisting she will. Thanks

Hi there

Unfortunately, without a court order, your ex can more or less do as she pleases and there is no legal reqirement for her to make your daughter available to you.

Hopefully you can sort this out in mediation, but if not the mediator should sign off the form to enable you to make a court application for a child arrangements order.

Hi There,

As Mojo has said without a court order she can stop contact with out warning.
.
Attend mediation and see where things go, and as said if things don't resolved you have a strong case in court especially as you have been seeing daughter had been staying with no issues for so long.
