Hi fellow members, Could I still by a house in my own name and live in it? ie if Im paying CMS, would this be counted as an asset if Im living there or its empty? Are there any circumstances my house could be taken off me? I understand as long as you pay your CMS your ok, and you dont put it on rent?
Thanks
hi,
it should be fine as its your home. if you own multiple properties, then CMS could look to take a percentage out of them, but only if your ex requests a variation of maintenance and she has evidence.
Hi Hope your well. Another query is that other than your income from work, are any other assets assessed, and when is this done. Are then caps on how much assets you can have?
I think the easy way to look at it is whether you pay tax on it, with regards to income, and assets other than you home (not actually sure about a car - I've never heard of a car being assessed, but if you had a car purchased as an investment, how would they decide that?). As above, CMS need to be aware of it to assess you, so if it's not something HMRC are aware of, your ex would need to do a variation to tell them.
