Has anyone ever ended there application and then with 6 months made a new application for contact and had the same judge .im really not sure whats going to happen im a few weeks away from handing in new application .as on last letter from court it said that peppa pig being me has to complete the recommended work before returning to court to progress with application and that should a new application be made it must go to same judge. So like i said i wasnt in a good place when i ended applucation i dudnt want to end it but felt like i was getting know where i also lost both grandads in same year and a good friend and also contact with my child stopped for no reason .ive since completed what work the court asked me to do and a few good courses off my own back to help with parenting .so my question is will cafcass have to do a full section 7 etc or not . .im in a much better place than last month as was very down now im ready to go again fresh fit doing exercise eating and sleeping keeping it child focused .i dont expect an easy ride i expect to be questioned on why i end application but i believe being strsight and honest and keeping child focused and showing them what ive done to try improve myself as a parent and completeing the work they asked me to do puts me in a good place .also the ex has tripped her self up in statements and lied and also tried to stop me having access to things that im entitled to about our child wish would show parent aliention but id rather focus on the positives .stay strong dads and anyone going through the courts one day we will have justice it just might take time
I would have thought that the court would need to reassess the whole situation, so I would have thought that a s7 wouldn't be unreasonable.
If the previous S7 was completed, I would have thought the court would just order an update called an addendum.
When you go to the first hearing, take a brief position statement with you laying out why you withdrew the initial application, why you are applying now, what steps you have taken for the children and what you are asking the court to do.
If the initial S7 wasn't completed, they will likely order a new one.
Make sure you apologise for any waste of court time and resources to get on the good side of the judge.
