Hi all, anyone have any idea what the costs of getting a contact order would be???

My ex is now messing me about seeing my kids, on the basis that they don't want to.

I have looked at the cost which is £200 to the courts but then there could be much much more if CAFCASS get involved, i am not eligble for any legal aid, i have heard that it could cost thousands.

I have already spent £2000.00 on solicitors with the divorce so far and a consent order which she has already gone against with maintenance issues and now she is playing up with the kids and the time we spend together.

My daughters are 7 and 4, any idea of what age their thoughts would be considered, i have read that as my daughter is 7, if she does not want to come, for whatever reason, she does not have to. although she has never said it herself to me or anyone in the past, only when her mother has said what they were going to be doing whilst they visited me making her feel like she was missing out.

The ex never supports the time my girls and i spend together and always, guaranteed kicks up just before and after my weekends, for no reason, making a big deal out of the smallest things, for no need other than her reasoning which makes no sense to anyone else i speak with.

mine is pretty scary.....16 months and £8500 later i've finally got my contact order set up, however she tried not playing ball and the judge quickly told her she would or face penalties!

its costly if you can't agree....if you've an ex like mine then suggest trying fighting your own case....i did when i reached my 8500 limit in sept last year....using the sound advice from this site helped me massively...Yoji and Actd are the guys....there are others here i've not mentioned but all great advice from people who've got the T-Shirts!!

Hi emeyetee,

The cost of a C100 to raise can cost you between £0 and £200.

You may qualify for a remission of fee's. This applies if your outgoings exceed or make up a significant portion of your income. For example, if you had an income of £1,300, and your household and living expenses were £1,200, you would qualify for a remission (reduction) in the Court fee's.

You can always submit along with your application an EX-160A form. This is best requested from the Courts. You can include additional monthly expenses, but will need to cite what these are i.e. Food/Leisure/Gym Subscriptions/Childrens Activities etc. Always put these to the penny, because as they say: pennies make pounds.

If you want any further information, please feel free to reply back. If so, an indication of your income and outgoings would allow me to give a more concrete chance of guessing if you qualify 🙂

Also, going through Courts, you may not need to have a Solicitor/Barrister represent you. It just takes a little composure and you'll be helped by Court staff (including Legal Advisers/Judges)

From the sound of the way your ex is behaving, it is very likely that she is going to mess around simply to increase your fees - it's not an uncommon tactic to make you run out of money and stop pursuing the case.

I would read yoji's guide t representing yourself at the top of the legal section, and seriously consider representing yourself. If you do stop using a solicitor, then the CCLC can offer free legal advice on here in addition to anything the rest of us can offer, or you could use your solicitor just to assist, while you do the bulk of the work.

In answer to your original question - it really is 'how long is a piece of string' - in my case (and this was totally separate to the divorce), it was £30 - £40,000, and that included a 20% discount because of family connections - so at full price, almost £50,000 - the original estimate was below £10,000 but my ex messed the court and my solicitor around, and every time she did, it cost me a lot more.

Cheers for the info guys, as scary as it may be!!

Although i earn reasonable wage i have no disposable income at all, net income of 1,900.00 and outgoings of 1,500.00 on bills alone,some of which i was left with by her. Then what is left goes in the pot for my partner and i to live with 4 kids, which does not go far i can tell you.

Contact with my kids has now been postponed as my eldest says she is scared of coming as i may be cross about her not wanting her phone which even after speaking to her yesterday over the phone i reassured her that it was her choice and not a problem, to then get a text from her mother saying she was still worried as she does not believe you, making out that i am really bad, which is so far from the truth, yet my younger daughter was still happy to come, oh, and then a threat of social services being involved regarding my daughters worry, seriously people, what is it with some women???

I have another four kids at home, 2 of my own with my current partner and her two from previous, there is never any problems with her ex's, if there is anything, we have them round and talk about it rationally for the sake of the boys as thats what matters, but my ex is not willing to talk, phone or in person, my partner went round there to see if she could get anywhere only to have the door slammed in her face by my ex's partner and shouted at to go away, whilst there was a child behind him, his or one of mine we don't know.

I have said i will be going to my solicitors and perhaps mediation if this continues to which she replies, 'go for it' knowing full well that if she sticks to the point that the kids dont want to come, they don't have to and she is clearly not supporting any relationship and i truly believe reinforcing her own views upon my girls.

So for the sake of my girls being stuck in a position with their mothers views and the smallest thing being blown up and every child potentially being involved, i have suggested we leave things until the girls are happy to come, but i dread to think when that day may be, another 2 weeks, month, years!!!!!!!

I can't fight through the courts, it would be distressing for my girls let alone i simply won't be able to fund it.......

Anyone have any ideas or comments on what is best???

As far as I know at 7 the court and caffcass can talk to your child to gets view from them, but I would have thought they would prefer not to involve them.

You can go through court with just the cost of the order itself as I did, the order cost were all I paid and I went without legal representation your children are missing out on having a relationship with their dad and you're great family unit.

Although the court process will be difficult for your children, the end result will be they get to have a good relationship with their dad.

I agree with Darren, your kids would miss out far more if you didn't go through court - explain to them that you are fighting to see them because they are extremely important to you - that's probably the best thing you can ever give them
