Hello all,

I need some advice please.  I've applied for a residential order for my 3 year old son to be able to live with me.  I am doing it without professional help.  I am just had the first direction hearing and after the court reading mine, my ex wife's and cafcass statements, along with my list of my findings of factual errors within the cafcass report, the court has ordered an addendum from cafcass and position statements from myself and ex wife.

However, my Cafcass Officer has left suddenly and my case is now being dealt with by a Practise Supervisor.  They tell me the addendum has been written by the original Cafcass officer but yet to be filed.  (Original recommendation from Cafcass "A very close case but child should reside with mother).

1/.  Is this acceptable?

2/  Should I push for a complete new cafcass report.

3/ Court has told cafcass to be at next hearing to answer my concerns, obviously it won't be her now?

Hi,

I think you should press for them to file the report as soon as possible. Usually it would have to be serious reasons for there to be a change in residency. Vast majority of time they order child to live with mother. They would not change my order to state that kids live with both parents, because they said there was no compelling reason for it. Your child is very young, and I would suggest you seek as much time with your child as possible, instead of pushing for residency.
