Hello everyone .First of all I am very glad to be a part of this group . It is indeed heartening to see various members lending a helping hand to those in stress.
Last week , I received my Decree NISI after almost 14 months of struggle. Just to set the context , I am a British citizen who married an Indian in 2015 . She married me in order to become a British citizen. When she was found out, she decided to leave and then filed a case of Domestic Abuse. This was rejected by the police after investigations.
Last week , she has sent a letter through her solicitor asking me to submit all my financial statements. Now , knowing her history , I do not want to send her any of my details. She is currently in India as her spouse visa status ran out.
What should I do please? My assets are as follows
30000 equity in my house in Manchester
70000 pension
70000 in debt -- i paid 50000 to her family in India when we got married as they were in serious debt..
YEs I was a fool but was in love,,
No kids ..married for 2.5 years.. and savings of 3000 pounds.
Please help...Any advice will be much appreciated.
Sorry to hear your sad story. Its a bit specialised so perhaps you could try to get half an hour free with a local solicitor to find out your options.
With it only a case of a solicitor writing to you on an ex partners behalf asking for financial disclosure.
You dont actually need to even respond or disclose your finances. Theres a procedure to follow and is she going to risk paying out thousands which she hasnt actually got to potentially end up with nothing. It maybe useful if you had evidence of you giving her family 50k as well.
Also a lot of solicitors if not virtually all would want paying in advance rather than at end due to all the complications involved and the risk of not being paid at end
It's worth getting an appointment with a lawyer to find out where you stand.
Unless a court are asking for disclosure, you don't necessarily have to provide this to her lawyer
I agree, even if you can't get a free consulation, paying for an hour would be money well spent in what you could save.
