[Solved] Advice on applying for PR & contact order together

Hi everyone,

Has anyone got any info on applying for a parental responsibility order & contact order at the same time please?

We're currently awaiting the arrival of the FM1 form after my partner's ex turned down mediation (it's been posted today) so we're in the process of filling in the forms ready.

From what I can gather he needs the C1 form and C100 form to be filled in, is this correct?

Also the C1 form asks if there are any other court cases concerning the children. There aren't as yet but we don't know if he needs to mention that he's also applying for the contact order?

The C1 also asks who cares for the children, their mother has a partner living with them do we put this name down also? Her partner also has a 16 year old son living with them, do we also put this name down? As an adult or child? There is a section asking if there are any other children i.e. brother or half sister but the 16 year old mentioned above isn't biologically involved and at that age we don't know if he'd be considered a child.

Finally do we need 4 copies of the C1 form (as you do for the C100)?

Just to add we have tried to call the court to find out about some of these questions but their voice mail says there's industrial action today so they're not answering the phone.

Hi Jayne

As for other court matters you could put, none other than the attached application for Contact Order

As for carer, just put the name of the mother down. The new fella does not pr etc.

However you do need to make reference to them in Section 12, any other adults living in the home

You do need to send 4 copies of the C1 to the Court with the C100.

Hi we applied for pr at the same time as contact. It saves money and time. it costs £200 to submit both together if you do it separate its £200 each

Thanks for the replies.

The first question on the c100 asks if he requires permission from the court to make the application. Is this yes or no with him not having PR? Also does a C2 form need completing (request for permission to apply to the court)?

Last question for now is does he also need 4 copies of the FM1 to go with the 4 copies of the C100?

Hi there 🙂

You dont need to submit the C2, just the C1 and C100 plus the FM1...as far as how many copies of the FM1, my son handed in the orignals plus three copies of all his forms including the FM1...they took them all and stapled them together into 4 bundles. The court keep the original copies, and they sent back to us 2 copies, one for us and one to be served to the mother, which we served to her solicitor. I believe some courts serve the papers directly to the respondent though.

Would that mean on the first question of the C100 "Have you applied to the court for
permission to make this application?", he'd tick "yes" or "permission not required" do you know?

Also on question 7 " Why are you making this application?" it asks for any previous arrangements. Over the 8 years they've been tweaked (always included a Weds & Sun, sometimes Thurs) 5 times, does the court need details of all of these?

Check out the Contact Order C100 Guide at the top of the Legal Eagle section it goes through how to respond to each section on the form, but I'd say yes you should list the previous arrangements...and tick the no i dont need permission box! 😉

Just to update we took the forms on Tues and now have a date for later next month. He just has to serve her the papers now.
