[Solved] Advice- not received position statement from ex

Hello

I have a hearing on Monday and have not received the position statement as ordered from the other side

It was ordered at the last hearing that position statements should be filed and served one week before the next hearing.

I have contacted my exes solicitor but all I’ve had is ‘it’s not ready?’

I’ve contacted the children’s guardians solicitor who says they have been chasing them all week with no answer?

I turn up on Monday at 9am for the hearing - I’m self representing- what do I say?

Maybe i will get the statement on the day of the hearing? But surely it’s wrong as it’s been ordered to be ready a week before?

Typical dirty tricks by solicitors.

I would guess you'll receive it just before you go in to court. If thats the case make the judge aware of the late submitted position statement.
Don't get arsey with the judge but ask for a short break to give you time to read through it and absorb what she has come up with.
I'm not saying to adjourn it to another day but say 30mins or so to give you time to go through it.

If its full of the usual lies and false claims and if you have evidence then you should ask the judge to adjourn so you can provide your evidence to prove yourself against the false claims etc...

Ask for interim contact and show why your children and you should have that interim contact....time taken to get back to court could be weeks or months and the kids shouldn't be denied access to you for any longer than necessary as it will be emotionally damaging to them and to their relationship with you.

Always make it child focused.

Late filing is unacceptable and happens too often, solicitors should know better!
