Quick question.
I am taking my ex to court in April. However it is about the finances not about child care.
I want to have more contact, ideally shared residence and have suggested we meet in mediation. Originally I was waiting for us to settle but this has gone on for some time and every day without contact is hard. Should I wait or start the paperwork since my ex wife is resisting?
Thank you.
Hi there
Finances and child contact are two entirely separate issues, but the two issue can run concurrently. Your first step would be mediation to try and get agreement, but if this fails the mediator will sign off the form to enable an application to court for a Child Arrangements Order.
If you are having no contact the sooner you try and get the ball rolling the better, in my opinion.
If the finances are as part of divorce proceedings, you can also ask for arrangements for the children to be settled as part of the settlement.
All the best
