[Solved] 'advanced' education!

I am applying for CSA to take over from a consent order dated back to nov 2003.
The issue is the order states that support ends after 'secondary' education is completed.
However the CSA and the courts now apply 'advanced' and 'non-advanced' education as deciding points - not secondary or higher/further education any more - as you may well know.

However any idea when this came in? And any background including do these new(er) definitions supercede the 'secondary' definition that the consent order refers to?

Thanks for your help,

Hi and welcome to the forum.

I'll ask out expert from CMO to pop on and give advice - it may be after the bank holiday though.

Hi, I'm Sarah, a Child Maintenance Options consultant.

If the CSA opens a case for you, their rules will supercede the conditions set out in the court order. The CSA has always used "full-time, non-advanced education" as part of their definition of a child.

You might be interested to learn (if you're not already aware) that it is no longer compulsory for parents to arrange child maintenance through the CSA. If they can reach an agreement with the other parent, they can make a family-based arrangement. With a family-based arrangement, no-one else has to get involved and parents can agree between themselves what counts as child maintenance, together with how and when it's paid.

For more information about family-based arrangements and access to useful tools and forms online you can visit www.cmoptions.org, or if you'd prefer a confidential chat you could call the Child Maintenance Options team on 0800 988 0988 (free from a landline).

For detailed information about CSA regulation, more guidance is set out here:

Section 55 (1)(b) Child Support Act 1991gives the definition of a child

http://www.legislation.gov.uk/ukpga/1991/48/section/55/enacted

Schedule 1 paragraph 2 of Child Support (Maintenance Calculation Procedure) Regulations 2000 defines the meaning of advanced education.

http://www.legislation.gov.uk/uksi/2001/157/schedule/I/made

I hope this answer helps you.
