Hello all,
Could really do with some help with this one.
At my last 'review' date in court, to check if the paperwork was ready for the final hearing. The Cafcass rep. was a no show for a very lame reason (didn't tell the court or myself prior) . Paperwork wasn't ready by the respondent/solicitor so a further 'review' meeting has been set,
I've just had an email from the respondents solicitor, stating they'll be seeking adjournment, due to the Cafcass rep. being unable to attend the second review.
Any one know where i stand with this? my three points i want to put across are:
1. Cafcass rep. no show last time didn't bat an eyelid from the judge or respondent/solicitor.
2. This is only a 30 minute review to check the respondents paperwork is complete. Then to set the final hearing.
3. This whole system is supposedly built on "The child's best interest". September was when i started the court process.
4. Due to legal aid, i'm not surprised there asking for further adjournments. That's in there best interest.
Any advice much appreciated. This process is taking it's toll on me and I'm losing the strength.
I'm not sure if there's a lot you can do, I suppose it would be up to the court to allow an adjournment, but I would think they can refuse it - if they llow it, you could make the point that this is the second one, and can you get an early hearing date set. Having said that, hopefully someone will be along who knows the procedure better than I do.
