2 am and wide awake cant help but think there will be another fence for me to jump over when cafcass give there thoughts on how to proceed with my contact case . Im trying to be positive but its so [censored] hard to, i hope cafcass are on my side when they put there views to the court on what should happen with contact but i just have a gut feeling they will make me do sonethink else like a silly parent course which in ten years in and out of court ive done about 13 times please please please let it be good news when they file there position recommendations with the court and let me be wrong.... good night my child i love you so much dad will never stop fighting x
Hi There,
.
It's so hard when you are stuck in the middle of all of this, your mind wanders and then you can;t tend to think about much else.
.
And I think when I was in the middle of it all, I went through every possible scenario and outcome and it drives you mad, I feel for you, and will keep my fingers cross for the right result.
.
GTTS
Unfortunately i cannot offer much comfort. Just take each hurdle as it comes, worrying aboutthings that haven't happened yet can send you potty (i know!)
If the incosistent CAFCASS were to suggest another parenting course or similar to what you've already done....challenge it at the hearing.....ask why they think you need to when you've already completed it however many times.
When i was going through the worst of the sh*te my ex was pulling on me, i had CAFCASS put in a report that "it may be worthwhile Mr. xxxx, attend an Anger management course and a parenting course" my response in court at the finding of fact hearing was simple....Why?
Why did they think i need to do these?...why, when i had proven there was no domestic violence, no abuse, no harassment, no threatening, no nothing, nor any history of any of those - and all backed up by both police records, emails, texts, CAFCASS's own observations of the ex and me....and contact etc... etc...
i argued that i am not an angry or incompetent parent....again with proof to back up these things.....but yes i was angry at being made to defend false allegations when she knows they were all made up lies to try and get me to stop legal action and allow her to take back control over my contact with my child.
At that finding of fact she admitted (Under oath) that i'd not been violent or abusive or threatening to her or our child....
the judge agreed based on all the evidence before him....called her evidence un-reliable and called her hostile towards contact.
can't say it gets any better other than it did for a few months....then back to court for enforcement....ok for a nother few months....then back to court for further enforcement and variation to order.....then ok for a few months....then back to court to see if i could get court to act on their warnings and penalites......that stopped her for almost 2yrs.
now i'm back virtually to square one....zero direct contact for almost 2yrs due to CAFCASS inconsistencies and a pathetic judge who just followed CAFCASS's latest recommendations....indirect contact for a while to "see if things improve"
don't give up but just take each battle as it comes....concentrate on things one at a time
Why do judges make such orders if they can simply be broken with no repercussions ???? Surely if a order is made then all parties need to stick to it like glue, I'm just starting out on my fight for my daughter and information like above is very very very scary, all the stress and worry and quality of life for our children and both parents for it to be just disregarded is very [censored] twitching, I prey and hope I don't have to go through this
my god this has me down even more, how come its taken 10 years of court? its killing me tbh after 2 years, seems mothers just get let of there is no enforcement????? so battle just goes on and on,,, and only the child will not only suffer , but dad aswell,, and mother will watch while you burn,, dads missing baby i no what your saying,,, last week i was on u tube farthers 4 justice , and a guy burned his court order ,, what the hells the point,, ? you face a daily battle in your own head,, the torment you have to go though,, is unreal ,, all in the name of ,,,, the farther,,,,?
I remember this part 1234homeland, either not being able to fall asleep, or waking up in the middle of the night with my heart pounding out of my chest, worried sick about how things were going to turn out. Even though I knew that the best I could do was to get proper rest and try to be as fresh as possible to keep going, I just couldn't. We're with you mate.
Dad-I-d has given you good advice; try your hardest not to worry about things that haven't happened yet... be in the here and now with your case and take each step, one at a time.
It's a slow process and if you're unlucky enough to have a weak judge, then things can go pear shaped... but what you must remember is that many, many cases are dealt with properly and with good end results, we just don't hear about them because both parties adhere to final order and things start working for them. Not all mothers are narcisstic psychopaths, a very small minority are, but the vast majority will back off once the courts have decided and do what they are ordered to.
As superprouddad says, we are all with you. If you are having sleepless nights then catch up during the day, just do your best to eat properly and do stuff that you enjoy to try and take your mind off the bad stuff.
All the best
