[Solved] 1st post need advice

This is my 1st post so sorry it's a long one
2 years ago I split with my ex wife I had a new partner and so did she at 1st everything was fine then she slowly stopped me seeing my sons and got social services and courts involved ,she told social services I hity children and used drugs both a lie anyway went to court got to see 1 son at contact centre she then stopped this and o was seeing him every other weekend taking him out everything going OK I have recently moved and haven't told her where I live as she use to come to my old house screaming and shouting and causing myself and my partner grief, now she wants my sin to come to the house and stay no heres the problem I don't want him to come to the house because she will then know where I live and my partner is worried she will make more lies up again and involve social services with our children ,so if we went back to court (which she has threatened) can they make me tell her were I live and can they force me to let my son stay here I have no problem taking him out just can't handle the stress as I suffer from serve depression anyway sorry for the long post many thanks

Hi there

If it goes to court, you can ask for your address not to be revealed to her and give the reasons as you have here. The court cannot force you to accept contact in your home or for overnight stays.

How does your son feel about not going to your house? Are you not seeing all of your children? Please don't feel you have to answer, but at some point your son may ask the same questions.

I am sorry to read your story, i can certainly see how it can be distressing to have someone coming around causing grief. Having said that, if this stresses you out, I can only imagine what it must be doing to your child ? I don't know how old your son is, but he's bound to be feeling the stress too, and he may well look up to you for protection.

I don't seey eldest son as he blames me for the split
My other son has always been happy with just me and him as he classes it as his time I've asked him on several accession if he wanted to see his half sister which he always said no but as soon as I moved my ex got funny and now saying I should have him every weekend Fri to sun night as I said I suffer with major depression and even my gp said it would make things worse if he cams here I feel incredibly sad that I don't see himore but my ex is making everything so difficult

The courts can't force you to have him for a full weekend, as long as your son is happy with the level of contact he has with you and doesn't wish to spend time with his sister, then that is all that's important to a court.

In any event she would need to invite you to attend mediation before she could make a court application.

Try not to worry, she won't be entitled to your address if you don't want her to have it and there's no need for her to have it anyway, if your son doesn't spend any time there. As long as you have a way of contacting each other in case of an emergency I don't see any problem for you.

General question that may be worth asking.....

If someone were worried about an ex (female or male) coming and causing trouble at your home and you've proof they have done it in the past.....would you be able to apply for a Non-Molestation order to set out that they cannot come within a certain distance of your home / you etc... ???
