[Solved] 1st appt/FDR what a judge will know???

Hi all
Just wondering if anyone has any experience as to how much of your case the residing judge will actually be aware of? It felt like the judge didn’t know a lot of the case and was only looking into our papers if a question was raised, I do hope they do some kind of research beforehand!

We have had our first appt for financial resolution, form e’s Exchanged and questions.

At the hearing, I managed to get what I wanted to move forward, new FMH valuations and morgage raising capacities as my ex has been cohabiting in our home since we separated.
That’s all well and good you may say, i am only arguing this point due to the usual games being played with her own valuations put forward to me along with their joint morgage raising capacities (all included in a somewhat questionable offer to settle), this was declined before the first appointment.

Now the judge has ordered for these to be submitted for the FDR, how will these requests be looked at for authenticity and transparency? The judge did not say how the evidence required is to be obtained.

The morgage raising capacity of my wife’s joint enquiry was just a simple on line bank enquiry that was printed off, she inputted her own value of the FMH and as we all know, these calculators can be fiddled for a better or worse outcome!

I’m self repping but I think I’m not doing a bad job upto now. I may take a solicitor into the FDR If I can.

have I missed the opportunity to clarify with the judge, how the evidence should be produced for the morgage raising capacities?
seems really strange that we will be inputting our own figures of what we believe as a house valuation, without average of the 4 been collected yet (as ordered by the judge), my wife’s joint morgage capacity can be easily fudged as we only know basic liabilities from her new partner that was on her Form E! I know for a fact that in 2 months time, he won’t be paying CM as his youngest will be 18 and working, that would be an extra £400 a month that will just be included and me and my girls will suffer for that!

Hi there

As I mentioned on your last post, I'm not up to speed on the divorce side of things.... I did link to some Info and recommended a good book written by a top divorce lawyer, did you check these out? You might find some answers there.
