well again brilliant advice , and agreed i may be a vit green and i accept any hep , guidence , l wether it critiism or not so cheers everyone for all the guidence
so , the interim has to be applied for on the c100 ? i looked so many times n never found any section or mention of it ..
im beggining to accept this is a massive task but im more than capeable finishing it and hope full i will eventually be back with my little one ,[censored] painfull isnt the worf ..
so i sent the c100 three days ago , with no mention on my part of the intrim appliation so that is a major setbak already , would a letter sent by tommorow to the court explaining i was inaware i had to aply before court and asking for it to be added or considderd in my case be benificial ?
im not silly enough to expect a interm contact to be granted but i can only march on n hope , the hardest thing to swallow is tge fact of being thought upon as any sort of threat to my angel , it , as i m sure many could sympathise with has ripped me too bits but im determined to stay alm and get her back

Hi,

I am in court for the first time on the 16th Jan and have a telephone interview with CAFCASS on the 7th.

Any tips I can offer as I go along I will.

Been a dad to my daughters for almost 10 years now, been about 16 weeks since I last saw them and had any contact with them at all so I know how hard it is. I've had daily contact for almost 10 years so I understand what youbare going through. Like you my girls are my angels and I feel soo bad that their mother has done this to them. It looks like i'm having to represent myself and will be getting my application in as soon as the courts open again. I was hoping to resolve thinvs in a adult way but looks like it's gonna be dirty tricks etc and a long fight. Good luck to you mate and please keep us updated.

Hi,

From my very limited personal experience you don't need to request interim contact on c100.

This can be generated at hearing. My solicitor had drafted and agreed one before court and court was really just a rubber stamping of this.

Not sure if this is normal though.

The interim contact request will depend on the individual judge, if you haven't put it on the C100 some will be willing to discuss at the directions hearing, some won't. Your best bet is to follow NJ's advice and write to the court (copying in your ex) and then you have covered all bases.

1626 is exactly right...some judges are sticklers and some will allow flexibility but strictly speaking if you want an interim contact order then you should request it on the C100, in the section that asks what you would like the court to do.

I have known judges refuse to discuss it in court because it wasn't requested on the C100, when the court office list the first hearing they give it a time frame and some judges will say that there isn't the time to discuss it if it hasn't been factored in at the time the hearing is first listed.

In Missing _Hims case he had a judge that was flexible so it was ok... I think it best to err on the side of caution and request it on application anyway.

I would write the letter, they may not have listed the hearing yet, as you've only just sent the C100 in.

Hi,

I agree with NJ, it does depend on the judge, when I sent in my C100, I didn't know I had to ask for interim contact, but the judge was great and set that up anyway, but you may not be as lucky, so get the letter sent in asap and send a copy to your ex too, I would send both recorded so you know firstly the court will recieve thiers asap and you will have proof that your ex has recieved hers.

i have drafted the letter to the court explaining my mistake and asking them to consider interim made a seperatete identical copy for my childs mum . I just want to know if it is a definate that ishould send it to her as i dont want her useing it as anuther cross against me . Ie... saying i pester her and so on ??
Just trying my best to be as quiet and keep out her sight .
I sent the origanel c100 on 29th ov dec . .. on a rough scale how long should i expect to wait for any kind of reply ?

Your ex can't use that against you. You would get in more trouble from court not sending her a copy of anything you send them. You can attach a note to your ex explaining that you are sending her a copy as per court procedure and do not require a response.

I didn't request interim contact and I wrote to the court requesting it in a polite letter but they just completely ignored it because the first cafcass report recommended against any sort of contact the scumbags so I think it may rest on what cafcass say but by all means write a letter to the court and try your luck 🙂

hi people , ok so everything is in place (i hope ) wrote to the ex and the court askin for the interim to be considered , so now i need to concentrate on the first hearing .
whatt should i expect then ? do i need to have any evidence in lace or any statements ? or does all that come after the first hearing ?
and roughly how long should i expect to wait for a reply ? i sent c100 on 29th dec ?
