Hi Guys,
I am not sure if there is someone good in EU law. I am separated nearly 4 year. I am paying child maintenance for 2 children regularly based on GOV calculator.
My ex has opened court case in different country to get more money from child maintenance (due to the different law and rules child maintenance is calculated based on her income not my)
She has declared that her income including all benefits in UK is £1100 - £1300 per month.
Honestly I cant believe that this is true.
Is there any chance that I could find out what benefits she is receiving for 2 children and/or herself please?
Or what benefits she supposed to receive as single mother of two (assume without income) please?

All benefits are worked out individually.
Turn2us have a website that you can calculate benefit entitlement on.
Thanks, I ran some simulation and it looks like that adult person with two children without any income should get in total around £1750 + Child maintenance.

Hi 1750 looks rather high, unless you are including Housing Benefit? In which case that could be it.. Plus child maintenance.. Without it 1100 to 1300 is right..

Hi Yes, she does declaring without housing support. I just received court order from foreign court to pay child maintenance in amount of £300 which is less compared to what I paid according to family based agreement.
Now my Ex want to claim £300 ordered by foreign court and child maintenance via CMS.
Has anyone been in a similar situation?

We are living in UK since 2005. Both girls are born here.
hi, whichever foreign country made the order, there could be a REMO arrangement in place between both countries.

would also be good idea to speak to CMS, and hopefully you don't need to pay 2 amounts.
It’s Poland and it’s on REMO’s list .
I have contacted Child Maintenance choice however lady on the line wasn’t able to help, she advices to contact solicitor.
So far I was playing according to the gov calculator results. When I received Polish court order my ex requested both payments.
I am not afforded to pay nearly £800 pm.
I just want to add that in Poland child maintenance miss payments are treated as criminal offense.
I also can’t find any info or similar case on internet.
you can check that REMO link i sent earlier, and write to that office in London. may be good idea to speak to a lawyer who is familiar with maintenance and REMO.
