hi all in need of some sound advise please.... ive split from my wife of 7yrs weve had a joint morgage for 13yrs which ive payed the whole lot since day one... bills morgage etc which was fine at the time..... now we have separated i will have to pay £475 a mnt for my kids which i dont have any probs with at all.... but as its a joint mortgage do i have to pay all or 1/2 and what about the bills as im not liveng there, im back at my parents...........
im paying everthing ,gas, elec, water, tv licience ,car insurance, mobile phone........... id like some advise on what im eligible to pay if pos please thnks for yr time
You are going to need to speak to a divorce lawyer, as you may have to pay spousal maintenance which is an unknown quantity. I believe that if your children are old enough to go to school, the courts do expect that your ex should be able to work to some extent. Part of the divorce settlement is likely to be that your children are provided with accomodation, and a lot will depend on your and your ex's financial statements.
hi thanks for reply she works part time min wage 16hrs .as i work nights i collect kids from school and look after them 4hrs everyday and have the every other wkend at the marital home as i cant aford a place while paying everything .do i have to pay whole mortgage or half as divorce hasnt bin started yet...thnkd again for yr reply
I would say (but I'm not an expert, which is why you really need legal advice) that you would need to pay the mortgage, or a proportion of it depending on your wife's income compared to yours, but if you are paying maintenance, then that should cover much of everything else. Even though the the divorce proceedings haven't yet started, you can still go and see a solicitor - try to get a free initial consulation, and write down any questions you have beforehand to make the most of your initial consultation.
