[Solved] Separted - can I charge my ex rent?

Hi,

My wife and I have been separated for over two years, but we're not divorced Yet. I moved out of our flat straight away, but have continued to pay the mortgage. My ex doesn't work. We have two kids, both under 18, and I'm paying maintainence for them, plus all the bills associated with the house. I'm at the point where it's very difficult for me to continue this situation. I'm maintaining two households. Is it possible for me to rent my flat (it's in my name) to my ex so she can claim housing benefit for it? The flat is in Scotland, but we got married abroad.

As far as I know it is not permissable to rent to family members, but it might be different in Scotland.

Is your ex on benefits? Why dont you google the CSA calculator, just answer a few questions and it will give you an estimate of what you should be paying. I would assume your ex must be in receipt of benefits if she's not working....I would have thought that the bills would be her responsibility. If you find you are paying more than the CSA guidelines and if your ex wont agree to a lesser amount you could use the CSA calculation to re-negotiate with her.

I would advise that you seek legal advice on a divorce as soon as possible to get the matter sorted out - you could have a word with the Citizens Advice Bureau.
