[Solved] Paternity rights agency worker

Hi there i am after advice i work for an agency and have done since before my girlfriend was pregnant. i work in a warehouse and now the company want to take me on as a permanent worker will this affect paternity leave or pay as technically i would be paid by new employer even though i'm doing same job in same place? would i be entitled to it anyway as an agency worker. all info is vague and concentrates mainly on the mother and her maternity rights. also my partner has mentioned this new shared parental leave would i get that???

Hi there

The only thing I can advise is for you to contact ACAS, I'm sure they will be able to give you the correct information.

Here's a link to their guidelines about paternity leave, but as your circumstance are uncommon it would be better to give their helpline a call.

Many employers will require you to be in employment for a certain amount of time before you are able to claim pat leave, this is often the same for mums, as you have been working for this company as an agency worker for some time, it would be worth trying to negotiate that they will pay you for when you baby arives within the package they offer, hopefully they will be willing too as you have been with them for a while.

As Mojo has said though ACAS can follow up and explain your rights for you.
