I've been advised to sort out our finances/custody out of Court with the help of a PIP plus course. When we went to Court I was after a 50/50 split of everything (including custody) but the CAFCASS officer told me he could never support this.

I'm going to make an offer direct to my wife. What are my chances of 60/40? (her 60 that is).

I would have thought that as long as there were adequate provisions for your children, then a court would be inclined to agree - BUT there are never any guarantees. Don't forget that any agreement you make in court regarding maintenance can be disregarded by the CSA after 12 months, so in this respect, I would agree to maintenance along the CSA calculation (15% of takehome pay for one child, 20% for 2, and 25% for 3 or more - changing to 12%/16%/20% of gross after October) so that there is no advantage to going to the CSA after a year.

I would suggest however, that you get specialist legal advice regarding the divorce agreement as that's beyond the remit of the CCLC - you could contact the Citizens Advice Bureau to see if they can advise.
