Hi this is my first request for help but I just don't know what to do.
I finally got my divorce in August 2013 all assets were taken by my ex, leaving me just my car worth about £10k although she did try to get it.
I have my own business which is just me. I hire out some technical equipment and do consultancy.
The business is going through a very bad patch and hasn't earned any money since October 2013. I continued to pay the child maintenance (court order) £618 per month for November and December until the small amount of money I had put aside run out.
I haven't paid my maintenance for 1st Jan 2014. I am doing some work at the moment but I wont get paid (Net £2000) until beginning of March 2014.
Due to my financial state I cannot afford my rent and gave my notice and will be moving in with my gf of 2 years with her 2 children (8years old)
I Informed the court in late December 2013.
My ex (We have the worst type of relationship possible) txt me after she got back from her weeks skiing in France saying that she is going to take me back to court for missing my maintenance. I explained my work situation but she says that she is going to court and that they will sell my possessions.
I'm now worried that she will not only send bailiffs round to my gf house, repossess my car needed to work and see my kids (64 miles round trip) My biggest worry is that she can somehow gain my gf's assets. (she has positive equity in her house)
I don't have much as ive had to sell almost every thing I own to survive.

Hi Viv,
I don't think she can claim your girlfriends assets as what she has has no bearing on your ex and your situation, I'm guessing the court order for financeswould have been set in August when you got your divorce.
If she does take you back to court I would imagine the judge wouldn't want to stop you being able to earn money so can't see that they would order you to sell your car. They would probably want you to set up a payment plan to cover the arrears.
I would write to the court and explain the situation and see what they suggest you do about not being able to pay.

I would contact the Citizens Advice Bureau on this to see if you can go back to court to get the order varied - ideally based on the CSA calculation - that way, if your earnings suddenly disappear, your maintenance would reduce also.
