[Solved] Help please - home repossesion

My ex and myself purchased a home that has around 150k equity, all based on an extensive remodel that I financed.

Court have refused to grant her occupation order and she has co-opted my business that they run together, bringing in about 300k per year.

Awaiting ruling from high court in relation to residency. Extremely confident that I will get at least 50/50 shared care.

Mortgage in her name and she refuses to let me deal with the bank.

Can I seek an order to have her do so?

Hi There,

I'm not sure on that if the mortgage is in her name then as far as I am aware the court would be able to order her to sell, but I'm not sure that they could enforce her to allow you to deal with it.

you would need to take some legal advice

The ex has admitted in court that she and her boyfriend are living together, and that they are running my business, albeit in a different name,.

How does that effect things ?

I would got with GTTS suggestion to get professional legal advice on this, what you are asking is something we don't have much experience with, so couldn't advice you with any degree of confidence.
